Lawyers Feeding Illinois

The initiative of ISBA President John Thies has been an overwhelming success!  Thanks go to everyone who participated in Lawyers Feeding Illinois.  President Thies (center) attended the PCBA's Diversity Luncheon last October and is shown here with John O'Brien and Justice Tom Kilbride.  Donations equaling 1,083,160 meals were collected.  Upon reaching the local goal of $5,000, the PCBA Foundation made its matching gift. 
Nick Bertschy (right) of Heyl Royster coordinated his firm's team and wrote, "I remain humbled at the great outpouring of support of so many in our firm, the Bar and the Bench."  As of the date of publication, Heyl Royster has raised $13,208.00 and 2,547 pounds of food.  Other participating firms were Fleming & Umland; Howard & Howard; Husch Blackwell; Johnson, Bunce & Noble; Kavanagh, Scully, Sudow, White & Frederick; Law Office of Richard W. BU Pre-Law Students Available

Is your firm looking for an intern or volunteer to run files, make copies, file papers, etc.?  If so, keep reading.  There are several Bradley Pre-Law students who will work at law firms for free so that they are exposed to a legal setting.  The idea is for the student to gain exposure to law firm life before he or she commits to law school, while the law firm is gaining work from the student.  Ideally, the student would be invited to attend depositions, court hearings, trials, mediations, etc., so that the student can see what it really means to practice as an attorney.  Please contact Nicole Meyer (Director, Pre-Law Center) at ndmeyer@fsmail.bradley.edu or at (309) 677-4186 if you are interested.

Fitness, Health & Wellness
The annual Strides for Justice event f/b/o Prairie State Legal Services will be held on May 18, 2013. This is a 5k run or 1 mile walk.  Check-in/registration begins at 7:00 a.m. at Tower Park in Peoria Heights. The race will begin promptly at 8:00 a.m. rain or shine, and is an out and back on Grandview Drive.  Online registration will begin soon.  More information will be in the April newsletter.

Committee Chair Gregory Rastatter reports that Heather L. Calvert and Caitlin “Frazier” Satterly have applied for regular membership. Pursuant to the By-Laws of the Association, this application will be presented to the Board of Directors at its April meeting.
On Friday, March 1, 2013, the Hon. E. Michael O’Brien, passed away. He was born on November 22, 1930, in St. Joseph, Missouri. In 1953 he entered the U.S. Navy flight training program and served as an aviator until 1958, attaining the rank of Lieutenant Commander. He then entered the U.S. Navy Reserve flying program at U.S. NAS in Glenview, Illinois. He Served as LTJG of Patrol Squadron Six, VP-6 Blue Sharks during the Korean War, receiving the China Service Medal and the National Defense Service Medal. After leaving the service he attended the University of Notre Dame Law School obtaining his J.D. in 1961. He entered the law field working as an assistant attorney general for the State of Illinois from 1961-1964. He then accepted a position with the U.S. District Attorney’s office where he worked until 1966, when he became the assistant state’s attorney until 1969. In 1969 he ran for Mayor of Peoria, was elected, and served until 1973. He then returned to private practice until 1990 at which time he was appointed to the bench as an associate judge in the Tenth Judicial Circuit. Judge O'Brien retired from the bench in 2001. During his years as an attorney he was the founding member of the Lawyers Assistance Program (LAP), serving on the Board of Directors and as President, offering aid to both lawyers and judges troubled by substance abuse. He was also a founding board member of the Proctor Chemical Center. Memorial contributions to the PCBA Foundation may be made at https://peoriabar.org/product/pcba-foundation.  The PCBA has contributed $100.00 to the Foundation in memory of Judge O'Brien.

People’s Law School
Thank you to PCBA members who make us look good every year at the People's Law School.  This a free event for the public at the North Campus of Illinois Central College.  The series began on February 21 with Sumner Bourne speaking on Foreclosure/Bankruptcy.  On March 7 Jim Rochford will be speaking on Landlord/Tenant matters, March 21 Michelle Eggert speaking on Family Law, April 4 Robert Pugh and Matthew Miller addressing DUI/Criminal matter, April 18 Timothy Kirk speaking on Wills and Estates.  The series will conclude on May 2 with Matthew Stropes speaking on Veterans Issues.

The YLC will be collecting suits again this year to benefit Dress for Success and Tri-County Urban League.  Please start collecting any gently used suits that you may have; the exact dates for the suit drive will be posted in upcoming issues of the LegalEase. Administrative Order 2013-06 - Courtroom and Judicial Assignments
The following judicial assignments are effective on the stated dates noting that the April 1, 2013 effective date shall be a function of the anticipated effective date of the Supreme Cout's Order appointing a resident circuit judge of Stark County to conclude the term of the Honorable Stuart P. Borden and therefore subject to immediate date change by operation of this order thereby conforming both events.

Court Reporting Services Seminar
Please be advised that Friday, April 5, 2013 is the Court Reporting Services Seminar in Springfield. There will be one court reporter assigned to Peoria and Tazewell Counties for EMERGENCIES ONLY. The Electronic recording will not be utilized on that day because there will be no court reporters present to monitor the equipment.

Peoria County Pro Bono Plan

The following attorneys and their staff have recently closed pro bono cases during the month: William Anderson, Sumner Bourne, David Collins, Julie Galassi, Steven Glancy, Jay Greening, Robert Muir (2 cases), Tyler Pratt, Karen Stumpe and Rich Williams. Thank you for your generosity.  We will be tallying hours in March for the Pro Bono Awards, so if you have any pro bono cases that can be closed, please return the closing information by March 15th to have your good work recognized. There will be a wills and advanced directives clinic held on Saturday, March 23, 2013, at the Peoria Neighborhood House. If you know of someone who needs this service and may qualify for our services, please have them call Sandra Crow at 621-4005.
Noteworthy Cases:
Many people think the only cases that are referred as pro bono cases are family law cases. Although, it is true that there are a high number of those types of cases, pro bono attorneys have made a real difference in the consumer law area. We are seeing more problems in the area of Contract for Deed sales. Clients are easily lured by the promise of owning their own home for much less than rent payments. Recently Angela Evans of Quinn, Johnston, Henderson, Pretorius & Cerulo helped a client with just that type of problem.  The client had found a home for sale on a contract basis on Craig’s List. She called and began negotiating with them. They were told the roof needed repair and some wiring was bad, and there were back taxes owed. After looking at the home, they felt like thy could easily fix it on their own and were getting a really good deal, until Code Enforcement paid them a visit and informed them the home was slated for demolition. The City referred the client to our office, and the case was referred to Attorney Evans who was able to get the contract rescinded and their down payment returned. This is another instance of the good work done by the volunteer attorneys who serve our communities.  Kudos to the City of Peoria for being proactive and referring the client to our office.
